1. Agreement to Terms
By creating an account or using Got It ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
These Terms constitute a legally binding agreement between you and Got It ("we," "us," or "our"). We may update these Terms from time to time as described in Section 18.
2. Eligibility
You must be at least 13 years of age to use the Service. By using the Service, you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and consents to these Terms on your behalf.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You are responsible for all activity that occurs under your account, whether or not you authorized it.
You agree to provide accurate information when creating your account. You agree to notify us promptly if you believe your account has been compromised.
We may suspend or terminate accounts that violate these Terms, at our discretion, as described in Section 16.
4. The Service
Got It is a home inventory application that allows you to catalog items, upload photographs, organize belongings by location and category, and generate reports about your inventory.
The Service includes optional automatic-identification features and household sharing features, described in Sections 8 and 9.
The Service is a personal organization tool. It is not an insurance product, professional appraisal service, financial advisor, or legal service. See Section 13 for important disclaimers.
5. Subscription Tiers and Fees
The Service is offered in tiers (currently Free, Premium, and Business) with different feature limits. The specific limits, features, and pricing associated with each tier are described on our pricing page and are subject to change.
We reserve the right to modify tier limits, features, and pricing. If changes materially reduce the features of a paid tier you are subscribed to, we will provide reasonable notice before the changes take effect.
If and when paid subscription billing is enabled, payment terms, cancellation, and refund policies will be communicated at the time of purchase.
6. User Content
6.1 Ownership
You retain ownership of all content you upload or enter into the Service, including photographs, item descriptions, notes, and other data ("User Content"). We do not claim ownership of your User Content.
6.2 License
By uploading User Content, you grant us a limited, non-exclusive license to store, process, display, and transmit that content solely as necessary to provide the Service to you. This includes transmitting photographs to a third-party service provider when you request automatic identification, and displaying your content to other household members you have authorized.
This license exists only for as long as your content remains on the Service. When your content is deleted, this license terminates with respect to that content (subject to reasonable backup retention periods).
6.3 Your Responsibilities
You are responsible for the accuracy of information you enter. You represent that you have the right to upload any content you submit (including photographs) and that your content does not violate the rights of any third party.
You are responsible for the content you submit to the Service. Do not upload content that is illegal, infringing, or harmful.
7. Household and Multi-User Features
The Service allows you to create or join households with other users. Household owners control membership and assign roles (owner, editor, viewer) that determine what members can do.
If you invite someone to your household, you are granting them access to the household's inventory data according to their role. If you are a household owner, you are responsible for managing who has access to your household.
If you join another user's household, data you add to that household is accessible to other members according to their roles. The household owner may remove you at any time.
We are not responsible for disputes between household members regarding data access, accuracy, or management.
8. Automatic Identification Features
The Service offers optional automatic item identification. When you use these features, your photographs are transmitted to a third-party service provider for processing.
You should understand the following:
- Results are estimates, not facts. Automatically generated brand identifications, model names, item descriptions, and value estimates may be inaccurate, incomplete, or wrong. You should verify them before relying on them for any purpose.
- Got It values are not appraisals. Automatically estimated values are rough approximations. They are not professional appraisals and should not be used as the sole basis for insurance claims, financial decisions, or legal proceedings. Whether an insurer or any other party accepts a Got It value or report is entirely at that party's discretion.
- Photographs are sent to a third party. As described in our Privacy Policy, images you submit for identification leave our servers and are processed by a third-party provider. Be mindful of what you photograph.
- Availability is not guaranteed. Automatic-identification features depend on third-party services and may be unavailable, degraded, or discontinued at any time.
We do not warrant the accuracy, completeness, or reliability of any automatically generated content.
9. Reports
The Service may allow you to generate inventory reports. These reports reflect the data you have entered and, where applicable, automatically estimated values. Reports are informational documents only.
Reports generated by the Service are informational tools to help you organize your records. They are not certified appraisals, insurance documents, or legal instruments. Whether any third party (such as an insurance company) accepts such reports is entirely at that third party's discretion. We make no representation that any report generated by the Service meets any particular standard or will be accepted by any third party.
10. Prohibited Uses
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to the Service or other users' accounts
- Interfere with or disrupt the Service's infrastructure
- Upload malicious code, viruses, or harmful files
- Scrape, crawl, or extract data from the Service through automated means
- Use the Service to store content unrelated to inventory management for the purpose of circumventing storage limits
- Misrepresent automatically generated information as professionally certified valuations or appraisals
- Create accounts in bulk or share account credentials
11. Intellectual Property
The Service, including its design, code, interface, and branding, is owned by us and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as intended.
Your User Content remains yours, as described in Section 6.
12. Third-Party Services
The Service integrates with third-party services (automatic-identification and email-delivery providers). These third-party services are governed by their own terms and privacy policies. We are not responsible for the practices, availability, or performance of third-party services.
If a third-party service changes its terms, becomes unavailable, or discontinues a feature, we may need to modify or discontinue corresponding features of the Service.
13. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing:
- We do not warrant that the Service is error-free, uninterrupted, or secure
- We do not warrant the accuracy or completeness of any automatically generated content, value estimates, or item identifications
- We do not warrant that the Service is suitable for any particular purpose, including insurance documentation, legal proceedings, or financial planning
- We do not warrant that data stored on the Service is immune to loss, corruption, or unauthorized access
You assume all risk associated with your use of the Service.
14. Limitation of Liability
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service, regardless of the theory of liability.
This includes, without limitation, damages arising from:
- Inaccurate automatically generated item identifications or value estimates
- Reliance on Service-generated reports for insurance claims or financial decisions
- Loss of or unauthorized access to stored data
- Service downtime or unavailability
- Actions of other household members
- Changes to or discontinuation of features, tiers, or third-party integrations
To the extent liability cannot be fully excluded, our total cumulative liability for all claims arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you have paid us in the twelve (12) months preceding the claim, or (b) fifty US dollars ($50).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.
15. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of the rights of any third party.
16. Termination
You may stop using the Service at any time. To request deletion of your account and data, contact us at [email protected].
We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to violation of these Terms. Upon termination, your right to use the Service ceases. Sections 6, 13, 14, 15, and 17 survive termination.
17. Governing Law and Disputes
These Terms are governed by the laws of the State of Indiana, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of competent jurisdiction located in the State of Indiana.
You agree to attempt to resolve any dispute informally by contacting us before initiating formal proceedings.
18. Changes to These Terms
We may revise these Terms from time to time. The updated Terms are effective when posted on this page with an updated "Last updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
If we make changes that materially alter your rights or obligations, we will make reasonable efforts to notify you (for example, by posting a notice within the Service).
19. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable while preserving its intent.
20. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Service. They supersede any prior agreements or understandings.
